Distance Sales Agreement

Article 1 — Parties

SELLER: Midella Living — info@midellaliving.com — midellaliving.com BUYER: The individual whose name, surname, and contact details are provided in the order form submitted on midellaliving.com.

Article 2 — Subject of the Agreement

This Agreement governs the rights and obligations of both parties with respect to the sale and delivery of the product(s) ordered electronically by the Buyer through midellaliving.com, in accordance with the provisions of Turkish Consumer Protection Law No. 6502 and the Distance Sales Regulation.

Article 3 — Product Information

The essential characteristics, prices (including VAT), and stock availability of the products are published on midellaliving.com. The products subject to the order and their total amounts are displayed to the Buyer on the order summary screen prior to payment. The Seller reserves the right to update product information, pricing, and availability at any time without prior notice.

Article 4 — Order and Payment

The order is deemed placed once the Buyer completes the payment process. Payment is made by credit card or debit card through a secure, PCI-DSS compliant payment infrastructure provided by iyzico. Payment information is not stored by the Seller. The Buyer's order is confirmed upon successful processing of the payment.

Article 5 — Delivery

Products are prepared and dispatched within 1–3 business days following payment confirmation. Estimated delivery time is 2–4 business days, depending on the Buyer's location within Turkey. Delivery is carried out exclusively to addresses within Turkey. The Seller is not liable for delays caused by the cargo company or circumstances beyond its control. The Buyer will be notified by email once the order has been shipped.

Article 6 — Shipping Fee

Shipping is free for orders totaling 500 TL or more. For orders below 500 TL, a shipping fee applies and is displayed at checkout before payment. The Seller reserves the right to change the free shipping threshold at any time.

Article 7 — Right of Withdrawal

The Buyer has the right to withdraw from this Agreement within 14 (fourteen) days of receiving the product, without providing any reason and without incurring any penalty. To exercise this right, the Buyer must notify the Seller within the withdrawal period by sending an email to info@midellaliving.com. The withdrawal right cannot be exercised for perishable goods or products whose packaging has been opened after delivery (including food items such as olive oil, olives, and soap), in accordance with Article 15 of the Distance Sales Regulation.

Article 8 — Return Conditions and Refund

Items returned under the right of withdrawal must be unused, in their original and undamaged packaging, and complete (including all accessories and documentation if applicable). Upon receipt and inspection of the returned items, the Seller will process the refund to the Buyer's original payment method within 14 days. Shipping costs arising from the return are borne by the Buyer, unless the return is due to a defective or incorrect product delivered by the Seller.

Article 9 — Defective or Incorrect Products

If the delivered product is defective, damaged, or does not match the order, the Buyer must notify the Seller within 48 hours of delivery by contacting info@midellaliving.com with photographs of the issue. In such cases, the Seller will arrange a free replacement or a full refund, including any shipping costs incurred.

Article 10 — Confidentiality and Data Protection

Personal data collected during the order process is used solely for fulfilling the order and is handled in accordance with the Turkish Law on Protection of Personal Data (KVKK No. 6698). The Seller does not sell, rent, or share personal data with third parties other than those necessary for order fulfillment (cargo companies, payment processors). Article 11 — Force Majeure

The Seller shall not be held liable for delays or failures in performance resulting from circumstances beyond its reasonable control, including but not limited to natural disasters, strikes, government restrictions, pandemics, or cargo company failures. In such cases, the Seller will notify the Buyer as soon as reasonably practicable.

Article 12 — Dispute Resolution

In the event of a dispute arising from this Agreement, the courts and enforcement offices of the Republic of Turkey shall have jurisdiction. The Buyer may also submit complaints to the Consumer Arbitration Committee (Tüketici Hakem Heyeti) or the Consumer Court (Tüketici Mahkemesi) in their place of residence or the Seller's registered location. This Agreement is governed by the laws of the Republic of Turkey.

Article 13 — Acceptance

By completing the order on midellaliving.com, the Buyer confirms that they have read, understood, and accepted all terms of this Distance Sales Agreement. This Agreement enters into force upon completion of the order.
